The 56-metre sailing yacht “Bayesian” sank during the night of 19 August 2024 off Porticello, near Palermo. Seven people died, including the British entrepreneur Mike Lynch and his 18-year-old daughter Hannah. Fifteen people survived, including Lynch’s wife, Angela Bacares.
The ‘Bayesian’ listed sharply to starboard within a matter of seconds and subsequently sank. The exact sequence of events is still the subject of investigations by the criminal justice authorities and safety authorities. The Preliminary report to date by the UK Marine Accident Investigation Branch is expressly not intended to be a definitive assessment.
The MAIB investigated the yacht, which was flying the British flag. According to its preliminary assessment, the ‘Bayesian’ had a critical weakness under certain operating conditions. This refers to the situation where the sails are furled, the swivelling keel system is raised and the yacht is carrying a specific load.
According to the model calculation, a crosswind of more than 63.4 knots was sufficient to cause the yacht to heel beyond the range from which it could right itself. The report states that even lower wind speeds are possible. This vulnerability was not identified in the Stability Information Book. Consequently, neither the owner nor the crew could have been aware of it.
The Italian public prosecutor’s office takes a different view of the events. According to information that has come to light so far, its investigation is focusing on weather monitoring, preparations for the storm front and the crew’s response. Allegations have been made against, amongst others, Captain James Cutfield, the chief engineer and another crew member. All those accused are presumed innocent.
A final report from the MAIB has still not been published. According to publicly available reports, the Italian investigations have not yet been concluded either. The public prosecutor’s office in Termini Imerese is said to have until February 2027 to complete its investigation. The conflicting assessments are therefore provisional and must not be confused with a final investigation outcome.
The wreck was salvaged in 2025 and taken to Termini Imerese. There, it is available to investigators and experts for further examination. Of particular interest are the actual state of the cargo, the position of the swing keel, possible points of water ingress, and the escape and access routes inside the vessel.
These investigations could shed light on how closely the MAIB’s theoretical calculations match the actual situation on the night of the accident. The British authority had already pointed out that the analysis of the wreckage could either confirm or alter its preliminary assumptions.
In parallel with the investigation into the accident, the financial situation of the shipyard group has deteriorated dramatically. In early July 2026, the Italian Sea Group applied to the court to enter into proceedings under Article 44 of the Italian crisis and insolvency legislation. The proceedings are intended, in the first instance, to safeguard operations and facilitate a restructuring or other solution. This does not, therefore, constitute proof that the company has already been definitively wound up.
The group owns, amongst others, Perini Navi, Admiral, Technomar and Picchiotti. The ‘Bayesian’, built in 2008, was constructed by Perini Navi. At the end of July, Sanlorenzo confirmed its interest in a consortium seeking to take over the entire operational business of the Italian Sea Group. According to Sanlorenzo, the offer is subject to further conditions and a subsequent competitive tender process. To date, this has not resulted in a completed takeover.
The economic crisis has coincided with an ongoing legal dispute. Italian Sea Group and its holding company are claiming 456 million euros from the owner company Revtom, Angela Bacares, Captain Cutfield and two crew members. The company argues that the sinking has caused significant damage to its reputation and turnover. The shipyard’s allegations relate to alleged negligence on the part of the crew.
The claim is therefore itself part of the dispute over the cause of the accident. Should the MAIB’s view be confirmed – namely that an unknown structural weakness played a decisive role – this would be of considerable significance for the legal assessment. It is for the competent courts to decide whether this gives rise to specific liability consequences. No final and binding decision has yet been reached. Two years after the sinking, one thing is therefore particularly clear: the ‘Bayesian’ is not merely a case for a maritime accident investigation. It is also the subject of criminal proceedings, a wide-ranging civil dispute and a corporate crisis. The investigations into the wreck and the forthcoming reports are now expected to provide the crucial answers. Until then, the causes remain a matter of dispute, and the presumption of innocence applies to all those accused.
